General Terms and Conditions for Online Auctions

 
(1) General, Scope
(1.1) These General Terms and Conditions (hereinafter "GTC") apply to all auctions conducted through the onlineplatform of [Company Name] (hereinafter "Auction House").
(1.2) The auction house offers antiques for sale on its online platform in its own name and on its own account by way ofauction.
(1.3) These GTC apply exclusively. Bidder's deviating terms and conditions are not recognized.



(2) Registration, participation
(2.1) Participation in the auctions requires registration on the online platform.
(2.2) Only natural persons with full legal capacity who have reached the age of 18 are eligible to register.
(2.3) During registration, name, address, and email address must be provided. The registration only becomes effective afterconfirmation by a verification email.

(2.4) The bidder is obligated to keep their access data confidential and to protect them from access by third parties.



(3) Auction process
(3.1) The presentation of the items on the online platform is a non-binding invitation to bid.
(3.2) The submission of bids usingautomated bidding programs (bidding agents) is not permitted.
(3.3) A bid expires if another bidder submits a higher bid during the auction period.
(3.4) The contract is concluded with the bidder who has submitted the highest bid at the end of the auction.


(4) Technical malfunctions
(4.1) The auction house does not guarantee the constant availability of the online platform.
(4.2) In the event of technical disruptions for which the Auction House is not responsible, the Auction House is entitled tocancel or extend an ongoing auction.
(4.3) 
In the event of a technical system failure, no claims can be made against the auction house.


(5) Prices, payment terms
(5.1) Prices are in euros and include the statutory value-added tax.
(5.2) The purchase price can only be paid by credit card, PayPal, or instant bank transfer.
(5.3) The purchase price is due and payable immediately after the auction ends.


(6) Warranty
(6.1) The warranty rights of the buyer are governed by statutory provisions.
(6.2) The descriptions of the auction items are made to the best of our knowledge and belief. They do not represent anywarranties in the legal sense.


(7) Applicable law, jurisdiction
(7.1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for theInternational Sale of Goods.
(7.2) The place of performance and jurisdiction, to the extent permitted by law, is the location of the auction house.


(8) Severability clause
(8.1) Should individual any provisions of these GTC are or become ineffective, the validity of the remaining provisions shall remainunaffected.
(8.2) An the place of the ineffective provision, an effective provision shall take its place, which comes closest to theeconomic purpose of the ineffective provision.
